When selling a used car in India, several forms need to be submitted to the Regional Transport Office (RTO) to complete the legal transfer of ownership. Governed under the Motor Vehicles Act, 1988, these forms ensure that the vehicle’s records are updated and liabilities are appropriately shifted from the seller to the buyer. Forms 28, 29, 30, and 35 are key to this process. These can be collected from the local RTO office or downloaded online via the VAHAN portal.
What is Form 28?
Form 28 is used to obtain a No Objection Certificate (NOC) from the RTO. This form confirms that there are no pending liabilities—like road tax, challans, or involvement in legal/criminal cases—associated with the vehicle. It is mandatory for interstate transfers and may also be required for intercity transfers in some states like Maharashtra. You generally need three copies of Form 28.
What is Form 29?
Form 29 is the official intimation to the RTO that the vehicle has been sold to a third party. It includes a declaration by the seller that all relevant documents such as the Registration Certificate (RC), Pollution Under Control (PUC) certificate, and insurance papers have been handed over to the buyer. Two copies of Form 29 are needed.
What is Form 30?
Form 30 acts as a follow-up to Form 29. It notifies the RTO to initiate the ownership transfer to the buyer and absolves the seller from any future legal or financial obligations related to the vehicle. This form must be submitted within 14 days of the sale. Two copies of Form 30 are required.
What is Form 35?
Form 35 is used to remove hypothecation from the RC in case the car was financed. It is submitted along with a No Objection Certificate (NOC) from the bank or financing institution, confirming that the loan has been paid in full. This step is essential to complete the ownership transfer if the vehicle was under loan.
Proper use of Forms 28, 29, 30, and 35 ensures a legally compliant and smooth transfer of vehicle ownership. Submitting these documents on time protects both buyer and seller from future disputes and confirms that all legal obligations have been addressed. Whether you're selling your vehicle within the same state or across state lines, these forms are critical to a secure and hassle-free transaction.
